IE Class Terms of Service

Use of IE Class's Service constitutes acceptance and agreement to IE Class's AUP (Acceptable Use Policy) as well as IE Class's TOS (Terms of Service). From herewith in this TOS, AUP, the usage of "us", "we", "our", "ours" shall constitute reference to IE Class, the usage of "you", "your", "they", "them" shall refer to client / customer of IE Class.

IE Class, Inc. shall have the right, at its sole discretion, to modify, add or remove any terms or conditions of these Terms of Service without notice or liability to you. Any changes to these Terms of Service shall be effective immediately following the posting of such changes on this website. The most recent version of these Terms of Service may always be found at http://www.ieclass.com/terms.php. You agree to review these Terms of Service from time to time and agree that any subsequent use by you of this website following changes to these Terms of Service shall constitute your acceptance of all such changes. These Terms of Service were last modified on October 16, 2011.

  1. Unauthorized Use of Lessons, Labs, Projects, or Exercises

    Teachers MUST have a current paid subscription to IE Class, Inc. to use any features on the IE Class website including lessons, labs, projects, or tools in their class or in any other teaching or instructional environment. Teachers who allow their account expire may no longer use any IE Class curriculum materials. Using our labs without a valid subscription is a violation of this agreement. We take intellectual property theft very seriously and we have progressive measures built in to identify schools and teachers using IE Class curriculum without a valid subscription.

    Teachers and students may report unauthorized use of any IE Class material to comply@ieclass.com. We do provide cash rewards for information on the illegal and/or unauthorized use of IE Class curriculum in the classroom leading to the recovery of damages.

  2. Pricing

    The current base rate for a new account is $350 and the current renewal rate is $250. Each school must purchase an individual subscription; multiple schools, even within the same school district may not share a single subscription. Additional student accounts, up to 100, may be purchased for an additional charge. Subscription rates are subject to change at any time. The rate in which you renew at is only valid for that one year and renewal rates are subject to change at any time as well. The basic subscription includes up to 75 student accounts and up to three teacher accounts per school. We do not prorate, or discount, the basic subscription rate for schools with less than 75 students.

  3. Payments

    Payments are due in full 30 days from the activation date of the Teacher Account. Accounts not paid within 30 days are subject to suspension until account is paid and a 10% late payment fee. The school agrees to pay all collection expenses, including attorney fees and court costs should IE Class, Inc. be required to collect on their unpaid account.

    Purchase Orders: Our preferred method of payment is with purchase orders. We will process the activation or renewal of an account upon receiving the purchase order number, however we must receive either the original or a copy of the actual purchase order. Purchase orders may be mailed, emailed, or faxed.

    Credit Cards: Schools may pay by credit card, however there is a $15 service fee added for renewals and a $20 service fee added for new accounts on all credit card payments. Promotional discounts do not apply to accounts paying by credit card.

  4. Account Renewals

    After paying a standard subscription rate, subscribers are eligible for a discounted renewal rate. Current rates are posted on the Subscribe to IE Class page. The discounted subscription rate does not include additional student accounts that may have been added. Inactive web hosting accounts and domain names will only be renewed at the request of the subscriber. Payment must be received within 30 days after account expiration date to be eligible for the renewal rate.

  5. Account Reinstatement

  6. If an account in good standing has expired, it may be reactivated up to one year following the expiration date. The cost to reinstate an expired account is $35 plus the current renewal rate amount. The renewal date of the account will be adjusted to reflect the date the account is reactivated. Accounts that have been expired for more than one year do not qualify for reinstatement and must pay the initial registration price.

    It is important to remember that payment is dues within 30 days of the date stated on the invoice. We try to give schools every opportunity to make their payments, however there are those that for whatever reason never make payment and we have to end up disabling the schools account. To reactivate an account that has been deactivated due to non payment, we must receive a new purchase order reflecting the outstanding balance, any applied late fees, plus the reinstatement fee of $. Schools that establish a history not payment, or paying significantly late will be required to make full payment in advance of the account being activated or renewed.

  7. User names and Passwords

    All user names and passwords must be assigned to individuals and kept private. Teachers and students may not post their user names and/or passwords on any website or distribute user names and passwords in any way. IE Class, Inc. reserves the right delete, disable, or limit any account, demo, student or teacher account without notice, who's user name or password is discovered to have been distributed in any way. Student accounts must be assigned to individual students and used by only by the authorized student. See section VIII for more information.

  8. Warranties

    IE Class, Inc. provides this web site, and its features, "As IS," "WITH ALL FAULTS" and the entire risk as to satisfaction, quality, performance, accuracy, and effort is with the subscriber. Due to the nature of the curriculum being online and printable, no refunds will be given. IE Class offers a demo account for teachers and educators to review, test, and approve prior to purchasing a subscription.

  9. Network Uptime & Availability

    IE Class does not guarantee continuous, uninterrupted or secure access to our service, and operation of our site may be interfered with by numerous factors outside of our control, including your districts network system and proxy server.

    Scheduled Downtime is any IE Class scheduled interruption of Services, for the purpose of system upgrades in order to provide for you better service. Scheduled downtime during the hours of 8:AM and 5:00PM CST will occur with as much advance warning as possible via notice on the Teacher Center page, with a minimum of 12- 24 hours notice.

  10. Special Offers

    At times, we will run promotional offers. Only one promotional offer may be used. To be eligible for the advertised promotion, the promotional code must be entered on the IE Class, Inc. web site with the purchase order number.

  11. Demo Accounts

    Teachers interested in evaluating the features on the Teacher Center of IE Class and previewing the lessons are invited to sign up for an IE Class Demo Account. Demo accounts are for the teacher's use only and should not be used as part of the course curriculum. The teacher may create up to 10 student accounts in order to see how to setup classes and create student accounts. The demo student accounts must not be distributed to students. Each school may only create one demo account. Once the demo account has expired, a subscription must be purchased in order to continuing using IE Class. Signing up for multiple Demo accounts for the purpose of avoiding paying for a subscription is a violation of this agreement. Demo accounts that have been expired for 30 days without being upgraded will be removed from the system.

  12. Paid Teacher Accounts

    Each paid subscription will include up to three Teacher Accounts for a single campus. The second and third account will be issued upon request. One account will be designated as the primary account and will be responsible for payments and for approving the addition and/or removal of other teacher accounts. Teachers are responsible for maintaining the confidentiality of their accounts and passwords and for restricting access to their computer while logged into the IE Class Teacher Center. Teachers also agree to accept full responsibility for all activities that occur on any student account they create.

    Accounts are assigned to individual schools, not teachers. Teachers who move to another school that does not currently subscribe to IE Class will not qualify for the renewal rate.

    If we discover that a teacher enters a fraudulent purchase order number to gain access to our curriculum for any reason, it will be our policy to consider the action a theft of services offense and will notify the school district and pursue appropriate action. We often discover this during billing.

  13. Student Accounts

    Student accounts may only be created for High School students. Student accounts are assigned per school, not per teacher. If a school has more than one teacher account, the teachers must inform IE Class via email as to how the allotted student accounts should be divided amount the teacher accounts. Teachers may create, delete, or reassign student accounts as needed. Under no circumstances may teachers create student accounts for other teachers, parents, or anyone who is not a high school student at the institution subscribing to the service. Student accounts are to only be assigned to a single student at a time and the first name of the student authorized to used the account entered in the account profile. Generic accounts may not be created, and two or more students may not share a single account. Student accounts that do not meet these guidelines are subject to suspension or deletion.

    Any additional student accounts added to the teacher's subscription will become part of the Basic Subscription and will expire with the teachers subscription regardless of when the additional student account was added.

  14. Online Lessons

    All IE Class lessons are for the sole use of subscribers. No lessons may be saved, distributed, or copied without the written permission of the IE Class staff. Any saving, distributing, or copying of the IE Class online lessons is a violation of this agreement. Any school found to be using the any portion of the IE Class curriculum without a valid subscription will be invoiced for the full subscription fee. Schools or individuals who continue to use the IE Class curriculum without subscribing are in violation of copyright regulations and appropriate legal action will be taken.

  15. Lesson Plan Manager

    The Lesson Plan Manager is provided as a tool to create and plan out lesson plans. Subscribing teachers may create lesson plans online and save them to our system. IE Class Lesson Plan Manager may only be used to plan lessons related to the curriculum provided on IE Class. Lesson Plans saved on on the IE Class system become property of IE Class and they may be used in for demonstration, training, or any other purpose decided on by IE Class without compensation being provided to the author.

  16. Lab Exercises and Projects

    All lab exercises and projects provided by IE Class are the property of IE Class, Inc. Subscribers are given the right to use the lessons, labs, exercises, and projects in their classroom only with a valid subscription. The labs are designed for, and tested in, Microsoft Internet Explorer. It is the teacher's responsibility to verify that the procedures in the lab, and lab code works with the browser used in the classroom before assigning the lab to the students. Lessons may not be distributed to any other school or used as examples in workshops or presentations without the expressed written permission of IE Class, Inc. To use IE Class curriculum in a teacher development workshops, please send us an email and indicate the nature of the workshop, dates of the workshop, the specific labs you wish to use, a contact phone number, and mailing address. Permission must be received in writing before any labs may be used in any workshop presentations. UNDER NO CIRCUMSTANCES may any lab exercise or project be posted on a school web site for students to download or any other public domain. The IE Class online lessons may not be copied and distributed in any printed or electronic format other than the subscribed teacher's individual classroom. The online lessons may not be copied and posted on a school website. Violation of this agreement is a copyright infringement and IE Class, Inc. will take a proactive position to resolve the situation.

  17. Quiz Builder

    To help customize the IE Class curriculum and activities to the individual teachings and lessons of our subscribers, we have provided teachers the ability to add questions to the Quiz Builder. By adding questions, you agree to assign each question to its appropriate category. Any questions added to the Quiz Builder become property of IE Class and may be used by any subscriber to IE Class. You also agree that any questions you add will be related to the IE Class Web Technologies Curriculum. Questions related to other courses are prohibited. The IE Class staff reserves the right to edit or remove any questions they feel are not appropriate, inaccurate, unrelated to the IE Class course, or for any other reason.

    Teachers are responsible for testing the Quiz Builder with their classroom computers to verify that it works properly before assigning online quizzes to students.

    We make no warranties or promises as to the accuracy of the questions or performance of the Quiz Builder. See Warranty statement above.

  18. Teacher Comm

    By using the Teacher Comm on the Teacher Center page, you agree to the following terms:

    • All conversations should be positive and professional in nature.
    • There should be no derogatory comments about any teacher, school, student, posted on the Teacher Comm.
    • There should absolutely be no student information or reference to an individual student posted on Teacher Comm.
    • Posting derogatory comments and complaints, about IE Class is prohibited. Issues should be brought to our attention through appropriate means.
    • Spamming and flooding is strictly prohibited.

    Any violation of these terms my result in losing access to the Teacher Comm or account suspension/termination. IE Class reserves the right to restrict access to the Teacher Comm to any, or everyone, for any reason.

  19. Teacher Contact Information

    Teacher names, a working email address, school name, school phone number, and school address is required of all subscribers. You agree to notify the IE Class staff of any changes to your contact information.

  20. Linking to IE Class

    You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of the Site so long as the link does not portray IE Class, Inc., its affiliates, or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any IE Class, Inc. logo or other proprietary graphic or trademark as part of the link without express written permission or other authorized affiliate agreement.

    IE Class, Inc. does not review or control third-party sites that link to or from the site, and is not responsible for the contents of any third-party sites linked to or from the IE Class web site.

  21. Loss of Data

    Teachers are responsible for printing and keeping hard copies of all quizzes that students take through the IE Class Quiz Builder, and for recording quiz scores in their own off-site records. IE Class, nor anyone associated with IE Class, will backup, or be responsible or liable for any loss of data, including messages, quizzes, quiz scores, or student accounts.

  22. Violation of Terms of Use

    Subscribers found in violation of this policy may have their accounts closed and will forfeit any unused time on their subscription. No refund will be given and possible criminal and/or civil charges filed for unauthorized distribution or use of account information, lab exercises, projects, or online lessons.

  23. Privacy Policy

    IE Class, Inc. does collect and store information entered by the teacher when registering for the account. The collected information is necessary to oversee the school account. The information collected will not be distributed or sold to any third parties or any other schools.
